Is it illegal to be a city of refuge?
The last couple of years we have seen a remarkable development in Sweden. More and more cities and even regions have made up their mind in favour of freedom of expression, international solidarity and uncompromised hospitality, to become cities of refuge for persecuted writers. Governmental actors, civil society organisations and a great number of engaged citizens have worked together with regions and municipalities in an outstanding teamwork to provide shelter for an increasing amount of writers and human rights defenders at risk.
When yet another city, the municipality of Gävle, decided to join ICORN and become a city of refuge for persecuted artists, members of the Conservative Party brought the decision to the Swedish Court to test the legality of certain aspects with regard to Gävle becoming a member of ICORN. On 1 July 2014 the ruling of the Administrative Court in Falun became public, concluding that “membership of ICORN falls outside the local authorities' competence”. Becoming an ICORN member and inviting a writer/artist at risk, the Court declared, might send a signal to the regime that the writer/artist was forced to flee from, and is hence “considered to be a question of foreign affairs”, which in turn is a State matter.
“This is really a surprising and disappointing verdict”, says ICORN director Helge Lunde in an official letter of response from ICORN. “It is very positive that the legal aspects of cities taking a stand for freedom of expression by inviting persecuted writers are tested out”, he says, “but this ruling is in best case superficial and defective, and could in worst case be regarded as politically prejudiced.”
In the letter, Lunde continues to question the court ruling: “If the municipal act of hosting a persecuted writer is regarded a foreign policy matter, and hence beyond the competence (and legality) of a city, how can the ruling Court legitimize any Swedish municipality receiving and protecting refugees? Wouldn’t any municipal refugee settlement also risk “sending a signal” to the regime the refugee has been forced to flee from, and in consequence be a state matter?”
Helge Lunde concludes the ICORN letter of response by saluting the massive opposition to the Court ruling from political parties, municipalities and civil society organisations in Sweden. He furthermore voiced a clear expectance towards the next and higher instance of Swedish Court to which the case has been appealed, to prepare and investigate it more thoroughly and seriously than how it was dealt with by the Administrative Court of Falun.
